Brazil - Broadcasters can freely define the daily schedule

The Federal Supreme Court (STF) published this week the judgment on the Direct Unconstitutionality Action of (ADI 2.404) presented by the Worker´s Party (PTB), with the support of ABERT, against the provisions of the Statute of the Child and Adolescent (ECA) that classifies as administrative infraction the Transmission of a radio or television program at a time other than that authorized by the Ministry of Justice.

With the publication of the decision, the broadcasters can already freely define the daily schedule, as long as they specify the indicative classification of the content.

The STF considered that the time linkage conflicts with the freedoms of manifestation of thought, intellectual, artistic, scientific and communication activity, guaranteed in the Federal Constitution, which do not undergo any kind of "censorship or license".
